Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Moovica iOS application, moovica.ai, and related services (collectively, the "Service") operated by Moovica ("we", "us"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum digital consent age in your jurisdiction, if higher) to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. The Service

Moovica uses artificial intelligence to transform photos you provide into cinematic posters, metadata (such as genre and creative copy), and optional short video stories. Features, models, quotas, credits, and availability may change at any time. Some features require a paid subscription or credits.

3. Your photos & content

3.1 Ownership

You retain ownership of photos and other content you upload ("User Content"). Moovica does not claim ownership of your original images.

3.2 License you grant us

To operate the Service, you grant Moovica a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, modify (including via AI), display, and transmit User Content solely to:

• analyze and generate posters, scene art, and videos you request;
• maintain your collection and enable in-app sharing features you choose;
• enforce these Terms, prevent abuse, and comply with law;
• improve reliability and safety of the Service (in aggregated or non-identifying form where possible).

This license ends when you delete User Content or your account, except for copies retained in backups or as required by law for a limited period.

3.3 Your responsibilities

• You must have all necessary rights and permissions to upload User Content.
• You must not upload content depicting minors in unsafe, sexual, or exploitative contexts.
• You must not upload non-consensual intimate imagery, hate speech, illegal activity, malware, or content that infringes intellectual property or privacy rights of others.
• If your photo contains identifiable people, you are responsible for obtaining any consents required before upload and sharing.

4. AI-generated output

• Outputs are generated automatically and may be inaccurate, unexpected, offensive, or imperfect. They are for entertainment and creative expression only.
• Moovica does not guarantee that outputs will match a particular style, genre, or intent.
• You are responsible for how you use, share, or publish AI outputs.
• Do not rely on outputs for legal, medical, financial, or safety-critical decisions.

5. Public sharing

If you create a public share link, anyone with the link may view the shared preview on moovica.ai. You are responsible for what you share. Disable sharing or delete content to remove public access.

6. Subscriptions, credits & billing

• Paid subscriptions and credit packs are processed through Apple In-App Purchase.
• Prices, renewal terms, free trials, and refunds are governed by Apple's App Store policies.
• Manage or cancel subscriptions in your Apple ID account settings.
• Credits and promotional offers may expire or change; unused credits have no cash value unless required by law.

7. Acceptable use

You agree not to:

• violate any applicable law or regulation;
• attempt to reverse engineer, scrape, or bypass quotas, paywalls, or security;
• use the Service to harass, impersonate, defame, or harm others;
• upload prohibited content described in Section 3.3;
• use automated means to access the Service without our written permission.

We may suspend or terminate access, remove content, or refuse processing if we reasonably believe you violated these Terms or applicable law.

8. Intellectual property

Moovica's name, logo, app design, and underlying software are owned by Moovica or its licensors. Except for the limited license in Section 3.2, these Terms grant you no rights to our intellectual property. AI outputs are provided for your personal, non-commercial use unless we agree otherwise in writing or a separate license applies.

9. Privacy

Our Privacy Policy explains how we handle personal information, including photos you submit for AI processing. It is incorporated into these Terms by reference.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOOVICA AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnification

You agree to indemnify and hold harmless Moovica from claims, damages, and expenses (including reasonable legal fees) arising from your User Content, your use of the Service, or your violation of these Terms or third-party rights.

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access with or without notice if you breach these Terms or if we discontinue the Service. Sections that by nature should survive (including licenses granted for already-processed content in backups, disclaimers, limitation of liability, and indemnification) will survive termination.

14. Changes to Terms

We may modify these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. Material changes may be notified in the app. Continued use after changes constitutes acceptance.

15. Governing law & disputes

These Terms are governed by the laws applicable to Moovica's place of establishment, without regard to conflict-of-law rules, except where mandatory consumer protection laws in your country of residence require otherwise. Courts in that jurisdiction will have exclusive jurisdiction over disputes, unless local law grants you the right to bring claims in your home country.
